The Client is a seed factory, one of the leaders of the agricultural market in Ukraine.
Problem:
The Client underwent a hostile takeover attempt, the purpose of which was a land plot.
The Raider had neither sufficient information, nor full package of documents, however, he operated with unofficial data, according to which the Client had not completed the formalization process of all the necessary documents on the right of ownership.
In order to initiate a criminal case, to conduct unscheduled inspections and to withdraw the missing documentation, the Raider sent official appeals to the police and the Archibudcontrol, as well as to the Client himself, demanding to submit the documents which confirmed the legality of his enterprise’s location on this land plot.
Process:
Upon beginning of work on this case, TEFFI Law Firm’s team developed protection tactics, the main tasks of which were:
- postponement of the inspection by representatives of the Archibudcontrol;
- riddance of prerequisites for the initiating of a criminal proceedings by the police;
- providing information to the Raider, which would slow down his actions.
Result:
- Unscheduled inspection was “set aside” for 3 months.
- During the specified period we could complete preparing the necessary package of documents on the land plot ownership.
- Following the results of work with the police, we have eliminated the grounds for initiating of a criminal case against the Client.
- The Raider received a legally competent response, the processing of which required additional time for his part, and after 3 months the project was closed without further progress.
