TEFFI Law Firm Wins Tax Dispute: Over UAH 53M Canceled Back

TEFFI’s Tax Disputes Resolution team defended the interests of an international agrochemical corporation — a market leader in crop protection — through both pre-trial and court appeals of tax notices-decisions (assessments). The project was led by Partner Igor Kryzhanovskyi.

The courts agreed with TEFFI’s position that the Client had no obligation to:

• discount liabilities under loans received from non-resident lenders;
• recognize as income the difference between the present and future value of such liabilities, including amortization;
• accrue VAT on services allegedly provided free of charge by regional representatives to distributors.

Outcome: additional tax assessments totaling over UAH 53 million were canceled by the courts.
